How can we help ourselves to get 2 year AP ? IV admins, can you kindly share with us any info regarding this ?
I know at this moment everyone is looking at the stimulus plan and economy, but , in the mean time we can prepare ourselves with some plan of action...
May be we should push for 3 year EAD/AP . Our argument should be, if we are 3 or more years away ( like EB3 India is currently 2001 or something ), we should get 3 year EAD/AP
Not meant to talk only for EB3 community, but in general as well.
Any thoughts IVians ?

My wife who is a derivative applicant for the GC is employed on EAD. She has been advised to go on a pregnancy short term disability leave by the doctor. We live in California and her company provides the short term disability through the California SDI.
Is it ok to claim this while having applied for GC. Is the SDI by any chance considered a public charge? Any help would be appreciated.

seems like its very much true, it happend in my case too, uscis sent my package back with reject notice of missing 797 even though the document was enclosed

Now things are not predictable. I prefer premium process with an extra 1000 USD

Your I-485 will not go forward unti they receive the 140 approval.
I-485 petition will be undated automatically as soon as the corresponding I-140 is approved.
As far as I know, you don't have to inform uscis about your I-140 approval.

Mine and my wife's 485 must have been "touched" today ... not sure why though. The status still says "Case received and pending..."

Hi All,
I sent h1b extension application to california center on june 22nd and my application is still not approved. My current visa was valid until July 30th. I need to travel to India on Dec 10th due to urgent reasons . Please suggest what should I do
1. Can I travel while my extension is pending?
2. Can I raise a service request to speed up the processing?
2. or Upgrading to PP is the only option?
I do have EAD and advance parole through my husband's GC application. If I use parole for travel what happens to my H1b visa and GC application filed through my employer. My visa will still be valid or not?
Please help...

Article says "On June 12, 2008, U.S. Citizenship and Immigration Services (USCIS) informed the American Immigration Lawyers Association that the H-1B random selection process has been completed. USCIS completed the intake and receipt processes for all filings as of May 24, 2008 and began mailing rejection notices the week of June 9. Therefore, if an employer has not yet received a filing confirmation (Form I-797C Notice of Action), it likely means that the petition was not selected in the random process and that the rejection notice will be forthcoming."
My hope is over now...All the best to all who r lucky.

Bottomline - if you are considering converting your LC case from TR to RIR, then your employer must send an email to DOL by Jan 20th and complete recrutiment process by April 1 ( or else case will be closed without recourse to appeal).

Please help me out on this.
My employer provided me with substituion LC with PD: Oct 2002, EB, and filed an I140 using it last year. The RD on it is Nov 2005. The 140 had 2 RFEs both asking for submission of original LC. As per the attorney the original LC was submitted with the application, and the attorney requested the CIS to get the copy of LC from DOL, as per the regulation as she says. Now this week CIS as send a denial on this case.
My questions are:
1. The attorney says, she can no longer get the duplicate of the LC from the DOL, as it's an old substitution case. Is there any other way, or solution on this?
2. The origianal LC was filed along with the I140 petition. Is that usual? Should all the originals must have been submitted only on request?
3. Is there any way to make this case alive again? What are the chances of approval if we reopen the case.

I have not used AP to enter so far but I do not believe AP is related to employment and questions related to that should not be asked when entering the country if one is using AP to enter. Just IMHO

i have been offered a job at my current research centre where i worked as a student. I want to go back to my home country. The job can be done online and does not require physical presence in the USA. Will i still need an OPT? or can they employ me as an international worker? if they wmploy me as an international consultant then what are the ramifications for teh company? wht is the legal procedure? will they have to pay taxes more etc?
Please help
