My friend is in H1. she is in bench since oct 2008. she had only one project for 2 months in 2009. but her employer is paying her also in bench, though the salary is less compared to what she was earning while on project. now her h1 is expiring in july 2010. now she is planning to use her EAD. but with EAD also she will be with the same employer(consulting firm). she is planning to visit India in may for one month and will be entering US with advance parole, not h1 visa. my question is that as she is in bench for so long time( though getting salary), will it be a problem for her to be back in USA. Is there a chance that she will be asked to go back from Airport as is happening with h1 holders.

You can do anything (including doing nothing). However it is the norm to work for the sponsoring employer (or the latest employer if you used AC21) for 6 month to 1 year to ensure that no question arises in future regarding the legitimacy of the job offer based on which your GC was approved.

Me and my family are travelling to India . Iam booking tickets and we may be passing thru these below countries. Pls let us know if transit visa is required. We don't have visa have only AP.

Does the window for appt opens for 6 weeks?
If I go without appt how do I how to go to consulatee without appt letter?

Am currently on F1 - OPT status (stem OPT). Been working as a volunteer intern for past few months. Currently one of start-up company is interested in hiring me but they do not have a legal department and also not enough resources to apply for H1B. I offered to pay for my H1B fees, but they have no idea how to go about this.
Can anyone please tell how do i go about this? What kind of lawyer should i approach , what information will i need from the company, how much money does all this involve.
The other option is start working for this company , get H1 done through a consultant and transfer the H1b, again this involves legal dept which neither me nor the company has any idea. Please advise .
My OPT is valid until Dec 2011.

Hi Guys:
My wife is out of country from October 2010. She was working on H1B. After birth of our son, she went to India for 6 month vacation. Will there be any issues if she re-enters US using H1B as she is having a job to continue with her employer.
What are all the documents I need to take.
Please advice.

Now that the I-485 gates have been opened, I would like to know what will happen to my spouse's H1B application pending before USCIS? Since I am planning on filing for I-485 for my spouse as well, will the H1B process make a difference? Or will the H1B approval cause any issues to the I-485 application?

Dallas-Fort Worth Immigration Lawyer Has Just Posted the Following:
Beginning March 1, 2010, Mexico will require U.S. citizens to have valid passports when traveling to Mexico. Legal residents of the U.S. must have their green cards or other documents demonstrating legal status in the U.S.
This new rule by Mexican authorities shouldn't change travel habits, because it has been the law in the U.S. since June 2009 that U.S. travelers returning to this country from Mexico must show their passports.

I went for Fingerprinting for I-485 case seond time on 9th May. When it is updated in your profile at uscis website. I see it is still showing up old dates as LUD.
Any idea ?
I gave my Fingerprints also. So far i did not see any LUD. I dont know what they are doing. Simply ignore it. There is nothing to do ourside.
