Nina Bernstein, one of the country's best immigration reporters, has a front page story in this morning's Times regarding 30 survivors of the January Haiti earthquake who were airlifted by Marines to the United States and are now sitting in detentions centers in Florida. According to the Times, these individuals were pulled from the rubble and were seeking food, safety or medical care at the airport in Port-au-Prince. I have searched lot of threads regrading AC21 when the new is less. I am currently working in a city. I have applied for 485 on July 2. 140 is approved. I am planning to move to rural area in the same state. Since the location is rural, the pay is lower than pay specified in my current labor. Since they also sponsor GC, I am sure the pay is higher than the prevailing wage.
Under these circumstances, is it ok to use AC21. Is it possible to argue that the wage is higher than the prevailing wage in the new EVL to be submitted with AC21.
I am aware AC21 is for "same or similar job". What about pay? ANy issuew with this.

EAD is for job
AP is for reentering US
Pending 485 is status in US
So, if she is not planning to work - then no need to apply for EAD

Swift 3D does not allow you to add special textures to 3D objects besides the colors and lighting. You will need to look at a 3rd party software package to enable texturing.

As i understand it it may take upto 6 mons and may even take upto a year. Is that a safe bet? to I am planning on a vacation in Dec and i hate to be in limbo. My wife's I-140 has been approved and we are in the worldwide category.
So what do you guys think, should i just go ahead and book the tickets now or should i wait to see what happens in Oct? I would like your opinions however contrary :D

Hello everyone,
This question is for my wife. She is currently in her 5th year of H1 which expires in Oct-2011. i.e Her 5th year ends on Oct-2010. She is planning to quit her job now (Aug-2010) due to personal reasons and plans to switch to H4. Her employer (Company-A) has already filed for her GC and her LCA and I-140 is approved, but I believe they will be discontinued once she quits. So here are my questions -
1. Since she will have a little bit over 1 year remaining on her H1, can she file for H1 again if she get a new job offer?
2. Assuming that her next company (Company B), files for a GC within one year, Will there be a problem getting her H1B extended ? Since her new LCA (with Company-B) will be filed less than 365 days before her H1b expires.
3. OR Will USCIS look for the LCA filed by Company-A and grant her H1B extension?

Yes. The old labor is valid for 180 days after July 16th.

I have an approved I140 and eligible to apply for I485. My wife is in the same situation.
Should we file separate? Or should I file only one application heither through my employer or hers?

Can anyone suggest if there is a way to check the priority date on a I-485 application after an interfile request has been made? I am not sure if a call to the Service Center is the only way, or if there is a form I can submit requesting this information.
The context of my question is this: My original I-485 application was filed based on a LC/I-140 approved by PERM with PD May 2005. But later, as part of backlog elimination, an older LC for me with PD Aug 2004 was cleared and my company's immigration law firm got another I-140 approved based on this earlier LC. They've told me that they contacted USCIS with a request to get my I-485 attached to the older PD. I would like to get this confirmed since a 9 month gap in PDs can easily translate to years more of waiting time.
Thanks in advance to anyone that can help out or suggest if I should be doing anything different with getting the PD of my I-485 changed.
