TSC 485 processing date says Aug 17,2007.
Does it mean, they reviewed almost all cases before Aug 16,2007?
My receipt date is Aug 13,2007. Notice date is Oct 10,2007.
So wondering whether they touched my case or still not?

I have been denied US Student Visa thrice before. But that was about 10 years ago in 2001. I have only 2 stamps in my passport showing "application received" because third time was by mail and passport was not required to be sent.
I have to apply for UK DATV visa as am travelling to europe with family via UK. No stayover in UK though.. just 5 hours wait each way on same terminal to change planes.
In application for UK DATV visa, should I mention 2 refusals or all 3, since there are only 2 stamps of "application receipt" on passport? Can these refusals have any impact on my DATV visa? I have been living in the USA since and current have I485 pending with valid EAD and AP.
Any suggestions or experiences would be helpful please.

I joined new job using EAD, didn't invoke AC21, my 140 was approved and I filed 485 in July2007.
There was a RFE for geographical discrepancy explanation and EVL from 140 filed employer or EVL from new employer if changed jobs on 04/29/2009.
(Changed address using AR11 after filing 485)
RFE on 485 on 04/29/2009
LUD on 140 on 05/01/2009
USCIS received EVL from new employer with AC21 - on 05/11/2009
LUD on 485 on 05/13/2009
LUD on 485 on 05/14/2009
Don't know whether they are soft LUD or Hard LUD.
Couple of questions, Is LUD on 140 normal when there is a RFE on 485?
Continuous LUD's on 485 normal?

Hi Guys-
I am on H1B, working in US. I got my status changed from F1 to H1B last yr and never got it stamped ever since. I am going to get married next month in India and would require a visa stamp on my passport. I believe it is a straight forward process but would appreciate your experiences and suggestions for this.
1. I am planning to take visa appointments both for myself and my future wife togther at the Delhi consulate (ofcourse by paying separate fee). Can I do that here in US for both of us?
2. Once I get an appointment, we both should appear togther for the interview (for my H1B and her H4) . Right?
3. The forms 156 and 157 are required to be filled during the interview but not while taking appointments. Is it right?
3. I will take all my docs. along with our marriage certificate, and pictures from wedding. Do I need something extra to that?
Please suggest me any other important thing which I should be aware of in this process.

Hi,
I�m currently on H1B, I'm planning to go back to my country for an extended period.
Few queries
1) Can my employer keep my H1B open and show that the job is available for me? If so, for how long can employer do that?
I may go for six months, year or more, depending on circumstances.
2) If after a year a new H1B is filled, by the same employer (given that old H1B cannot be opened for long) will I be able to utilize the old quota or would have to file in new quota.
3) If I come back after a year, does the 6 year counter restarted? ie. the limit of working for six years on H1B.
4) If my employer cancels my H1B, and after six-months or a year, a different company files a petition for H1B, will the petition fall in old quota? Or will have to wait to be filed in new quota for that financial year?
If someone could answer my queries and help me decide, it will be very helpful.

He is my attorney for my GC process. He had successfully done my PERM application last year and now we are processing I-140 from last 4 months. Best thing is that he is quick and his paralegal call/email you whenever they miss any document instead of waiting for long time and going thru employer channel which consumes lots of time in between.

Hi,
I have applied for my H1B transfer from my current employer to a new company. I have not had any issues with my current employer with pay or anything like that. I have maintained my H1B status with my salary coming on time as promised and have all the paystubs and correct documents. My new employer is a big american MNC and they have hired a well known law firm for transfer process.
My only question is I have not informed my current employer yet and will inform him in a weeks time once my LCA is done and transfer is filled. He will not be very happy about this and I have initially signed an offer letter which says I will work with him for atleast a year and its only been 6 months so far. Can he create any problems in my transfer by cancelling my current H1 or any other problems with my reliving? Pls help.

Hello Everyone great community here and very useful information.
Received the email from Cris I-140 approved today.
I just would like to know how long it should generally take for I-485 approval. Now visa's were current when I file I485. What is the status now do I have to wait for visa's to be current again? Sorry for lack of knowledge GC process takes so long sometimes its good to just forget about it :)

On Aug. 13, 2010, President Obama signed into law Public Law 111-230, which requires the submission of an additional $2000 for certain H-1B petitions and $2250 for certain L-1 petitions. Those who are subject to the additional fees include petitioners who employ 50 or more U.S. employees and more than 50 percent of its U.S. employees are in H-1B or L status (including L-1A, L-1B and L-2). For example, ABC company has 60 employees and has 35 employees in H-1B and L-1 status. ABC Company would be required to pay the additional fee for all new H-1B and L-1 petition filings. Extension of status petitions are not subject to the additional fee. The new fees are effective immediately, applying to all petitions submitted on or after Aug. 14, 2010 through Sept. 20, 2014.
