Guys, I could use some suggestions here. I had filed for my and wife's EAD on July 30th. My wife wasn't working and my EAD is valid until mid-November. However recently my wife got a job offer and will starting work next week. Her EAD actually expires 15th Oct. Reading through posts it seems that the chances of her receiving EAD approval within 75 days is highly unlikely. Can anyone give suggestions on what is the best course of action to follow to ensure she doesn't have to take a break soon after joining?

I have a question about H1B transfer. I joined a company A on h1b in may 2005 and did an H1B transfer on july 2006 to company B. Now INS has sent an RFE (for company B financial). I have submitted all the relevant documents when I joined company B for H1B transfer so my credentials are crystal clear. Now when the comhpany B sends a response to INS and if H1B does not get approved. Would I be able to do an H1B transfer to any other company. I spoke to one company they are saying that since the RFE is on the company's credibility so they can do an transfer provided if we submit all the paystubs which we got from company B. I have been working for a client and have all the recent paystubs. Please advice.

I got my first job in june 2005 and was on my OPT until dec 2005. My H1-B was filed by this company and it started from Jan 1, 2006. Now I left the company in Sept 8 2006 and joined a consulting (vendor) firm. I am a contractor at Microsoft through this firm. This firm filed my H1-B on Sept 9, 2006. Now, 2 weeks back, when I checked the status of my case, I saw USCIS sent an RFE requesting more documents from my firm regarding the contract and type of job description. They gave a deadline until feb 2007 to submit docs.
My first initial contract length at Microsoft through this firm is until April 2007, but is more likely to extend for another 6 months.
Now my question is, since I cannot be sure if the contract will extend, I am starting to look for jobs...If I get a job, will it be alright to accept it and have that new company file my H1-B even though my current H1-B from my current firm is still in process and not approved yet?

Guys,
I need some advice and your own experiences.
Right now i am with company A(EB3-I, PD:12/2001) and 485 is in progress.
I have another approved I140 with Company B in EB2 category(PD:05/2006) and i did not try to recapture my PD at that time.
My question is, if i interfile company B 140 with Company A 140 would i be able to recapture the EB3 priority date. I do not want to loose the old priority date.
Any pointers or own experiences would be helpful.

I have an approved I 140 application and I485 not applied as the dates are not current. I have an opportunity to work for the same company same job profile and job code but in a different city. The new city falls under the same Metropolitan statistical area. Do I still need to re file my perm and I 140 in addition to H1b amendment ?

I started to notice this back in 2006 when the immigration debate was heating up in Washington. I was getting those annoying email forwards and this time they were of the Lou Dobbsian anti-immigrant variety. The surprising thing to me was that most of them were coming from older family members or acquaintances in the senior citizen set. what is the right address to submit the I485 / EAD and AP using Fedex and fill it in Nebraska?

850 S Street POBOX 87845 ?
I'm confused becase in the CIS site give the address in parentesis mention to write down the right POBOX.
What if she maid a mistake and send the paperwork to POBOX 87485?

I will be in DC, and we have rented a bus departing from wallace NC monday at 12:00hrs I still have sits available, we will drive to rRaleigh, the Virginia then DC

1)I am on H1b visa and currently i am on bench. My 140 is approved and my H1b is expiring on sep30 ,2009. I got rfe for h1b extension asking for client letter.
Should i convert to h4 or do h1b transfer if i could be able to get someone to transfer it.
2) Also if I go to h4 visa will my green card processing with priority date remain same if i go back to same employer and ask them to file my h1b again after i get a project. Or they again have to start the process again even with same employer. Also what if i go with different employer.
3. If I apply for H4 visa now and in mean time i get a project before sep 30 2009, then what do I need to do. can i just ask my employer to again file h1b extension.
4) SO if I do h1b transfer or go on h4 what are the pros and cons.
Please let me know ASAP.

I got my H1 approved in Oct 2004 and it was from Oct 2004 - Oct 2007. I used only 6 months of H1 and later went on TN (work visa for Canadian citizens) and remained in US working on TN for 4 years. I was in US all these years. Now even the earlier H1 approval duration is over, Can I apply for H1 with another employer using the old 2004 H1 quota cap or it has to be under new 2009 cap? Thanks in advance.
Your H1 is NOT subject to cap as you had H1 in last 6 years.

I need some clarity on this issue. I know AC21 helps switching jobs within the same field/duties, but here is my line of thought... I'm past 2yrs on my H1 and I plan to do a part-time MBA (~3yrs) after which I'd like to be open on the kind of job I do.
Now, my questions are: (1) Does switching to EAD really pause the H1 clock?
(2) Is that triggered by filling a new I-9 form alone, or by entering the US on AP, or both?
(3) I guess, I should be able to apply for a fresh H1 with a new company and switch back from the EAD to new H1, right?
I know I'll lose the GC priority, especially wife's EAD, but I'm debating if it's worth losing my career aspirations? My info: Nov '06 EB2 PD, approved I-140, July 3 I-485 receipt and my present company will file our EAD/APs as long as it is necessary.

If I apply for H1b in April, 2008 and choose consular visa processing, and the H1b starts in Oct, 2008. Do I have to go to the consular for a H1b visa? I might receive a EAD from 485 before October, and if I do, I would like to use EAD but keep the option of H1b open.
Can anyone answer me???
Say I don't activate my H1b in Oct 2008, but H1b is valid for three years, does it mean I can activate it any time by going to the consular for a H1b visa from 10/2008 to 09/2011? Of course I will keep my status valid (AOS) throughout the period.

I am working for a client which gave me an offer for a respectable amount. it is much higher than the amount specified in ETA 9089 (F/5) column. my Onet code for the original labor is 15-1071.00. my new job is defined as System Specialist. my job functions( roles) are pretty much the same as my original labor certificate. I tried to search the Onet Code for System specialist and did not find a good match.
Can any one suggest me what are the options.
I also wanted to know weather USCIS will send any letter to new employer regarding to the offer extended to me. MY situation is the client is not willing to sponsor me.

Your company's HR/legal should be able to give you an answer on how to reply to the NOF. I think they just have to show that they need you in the location that they put on application. Just make sure that EVERYTHING on applciation pertains to that same location - i.e market wage rates etc etc. If for some reason they do not have experience in these matters, try and get a hold of that NOF and go see a real lawyer. And word to the wise - be prepared to pay a little for the advice that you get. You always pay for what you get- so don't go to some 2-bit lawyer who will charge you $100 for answering questions when you can pay $200-$250 for someone who will give you worthy advice.
