My I 140 approved under Eb3 if i want to change my job and my employer is willing to do in EB2 can I use my old PD from I140 EB3 ?

The company can apply for her H-1B on or after April 1, assuming she is subject to the cap. She will be cap-subject if she has never held H-1B status before, and if your company is not cap-exempt. Assuming she and the position meet the usual H-1B requirements, it should be approved for a 10/1 start date.

Hi,
Am on H4 and applied for H1B in May 2006. Because of emergency, we need to travel out of US; got the approval on Sept 7th and returned to US on Sept 10th. I lost hopes of Change of Status petition approval(as one of my friend's COS petetion is rejected eventhough she didnot leave US during H1 process), but surprisingly when I received my papers today, it is approved with old I-94 number. Thank God.
Now, Can I go ahead and apply for SSN. Can they ask me to go for stamping as the I-94 on the approval notice is different from the current I-94 in the passport?

One of my friend got their Fingerprinting letter and the last name is misspelled. What should they do go ahead and take it to the FP office or call USCIS and get it corrected.

One of the comments on my post earlier today about the killed Border Patrol agent seemed pretty harsh - accusing most BP agents of being restrictionists with bad motives. I still think that's harsh and most Border Patrol agents are honestly out to do the necessary job of protecting our country's borders. Do not do this - please stop playing around with USCIS rules. There are sometimes unfortunate circumstances where folks lose status (e.g., OPT -> H1b) or are kept in dark about their H1B status by employers but for folks who break the law in a way that you are suggesting, I believe they should be punished.

Need advice ...I am currently on H1 B.
six years back (on F-1) I started working 2 business days prior to my CPT started.... Unfortunately ... that meant I did work unauthorized for a couple of days. Now I am at a stage where I need to use CPT experience to apply for PERM. Would stating the actual start date on form 9089 (which happens to be 2 days prior to actual CPT start date listed on I 20) pose any future issues?
CAn I be granted lineancy (something like 245K) if in in future this lapse becomes evident to U S C I S. How seriously would this minor violation be treated?

My PERM job description has requirement for Bachelor degree + 4 years experience. It is clearly specified in the PERM and ads that for every missing year towards 4 year bachelor degree, 1 year of experience would be accepted.
My PERM is approved. In the new I-140 form effective 11/23/2010, for EB3, it clearly asks to select either e) Professional or f) Skilled worker.
My understanding is Professional category can be chosen when the candidate has straight 4 year degree. In my case, I will be meeting the bachelor degree requirement with 3 year degree + 1 year experience. In this case, my belief is Skilled worker category should be chosen. Please let know if my understanding is correct.

The Memphis Commercial Appeal reports on today's citizenship swearing in of Irish-born James Patrick O'Donnell. Mr. O'Donnell immigrated to the US at the age of 4 in 1926 and fought for our country in World War II and won a Bronze Battle Star. With 165 members, the bipartisan Congressional Bike Caucus promotes the use of bicycles as a substitute for cars -- a way to exercise, reduce fossil fuel emissions and improve travel patterns. The caucus shepherded $4 billion for trails, bike paths and pedestrian facilities in a big transportation spending bill in the last Congress.
The bike caucus is just one of the zany-sounding groups that lawmakers have created on Capitol Hill to advance niche interests in Congress. There's no trick to creating a caucus -- or "congressional member organization" -- in the House, where it takes just a letter to the Administration Committee. Nearly 300 have registered. The Senate has far fewer groups, and they don't register at all.
But some caucuses have come to play prominent roles on the front lines of Capitol Hill. The Republican Study Committee has worked to amplify the views of the more conservative wing of the GOP. Since Democrats took control of Congress in January, the Congressional Black Caucus has wielded unusual power, with five members serving as chairmen of House committees.

I have a question; my girlfriend came to the US with a tourist visa in 2002 (now her visa is expired), so now I guess she is an ilegal alien, my question is: Is there anyway she can become a legal resident?
