I think you should be ok as long as the I-140 isn't revoked. Green card is for future job and so you dont need to be currently working for them.

First of all I am filing by postal mail USPS(not e-filing)
1)is it necessary to include I-765 receipt notice(EAD) with my AP application.. But I have only my last years one which will expire in a few months.
2) for AP renewal is it necessary to include marriage certificate for spouse
3) When filing by postal mail, and also considering i applied my I-485/I-140 before july 30/2007, old fee schedule... do i need to pay biometric fee for my renewal
4) I am in Texas and for mailing EAD and AP - can I send them together for me and my spouse. I see different PO Boxes for EAD and AP addresses for the Mesquite, TX address
IN I-765, is it enough only to specify the previous EAD information regarding the office filed and receipt date...or do i have to include my OPT EAD as well as my previous EAD filed last year.

Hello,
I am completing 4 yrs of my H1 and currenty working with company. I already have my PERM & 140 cleared through this company (EB3).
Hence, if I continue with this company, I do not have to worry about 6yrs limit on my H1.
However, if I have to change my employer:
1. Now?
2. After completion of 6 yrs (i.e. H1 extensions) would I be able to do that?
Also, what will happen with my GC? Will that be fresh start from scratch?

No, I haven't used Optimaze yet. Their reports say that SWF files are significantly reduced in size. I don't have any first-hand experience to tell you if it is true or not though :(

Hello,
I have just got my green card and I am filling out I-130 form for my older son who was 21 when I submitted my I-140.
My question goes to point 16, "Has your relative ever been under immigration proceedings?" as I am not sure what to check over not knowing the terms (Removal, Exclusion/Deportation, Rescission and Judicial Proceedings).
I am asking that as my son has been denied admission in the US last summer. He had an F-1 visa (through 2014) but changed schools, got another I-20, went to the US Embassy in my country, the Embassy denied him a new F-1 visa but they didn't stamp with "Cancelled" the F-1 visa in his passport so he thought the visa is still valid, returned to the US but in airport he was not admitted entrance and had to fly back to our country.
Sorry for my long explanation I just want to find out if what happened to him falls under one of the 4 Immigration proceedings under article 16 in I-130 form.
I want to get him here not have him banned for ever for not knowing correctly the terms.

My parents-in-law visited the USA in the last week on B1/B2 visa. At the port of entry the immigration officer marked the expiration date on I-94 for my father-in-law for 6 months and however did not mark the expiry date on my mother-in-law�s I-94.
As they are visiting first time they did not know the procedure and they could not bought this to the immigration officer�s attention before they left ?
I assume they entered the expiry date in the system for my mother-in-law since both applications were processed at the same time with the same officer.
How this can be fixed ?
Is there any way I can call DHS and confirm the I-94 expiry date in the system ?

Am I eligible to transfer to a TARP company for a similar position but in different state? Is there any specific policy or limitation for this work status? The company's HR couldn't make a decision. What should I do? Thank you very much for your kind and generous help.

I just looked thru couple pages on this forum to see if there is already a thread on this question but didn't quite get to see it.
I got into the I-485 queue during July-07 VB fiasco. My applications reached USCIS before the Aug-07 fee revision, so I paid fees according to the old schedule.
However, I did apply for extension last year in March-2009 and paid the new fee ($305), got the documents and even travelled last year and came back into US using the AP.
Now it's time for renewal again, and I'm wondering if I'll have to pay the fee perennially annually?

P.S: In the I-131 instructions, on page 8, there is a note regarding fee which talks about no fee if I-485 was filed after July 31, 2007. Mine was filed after July 31st, but with the old fee structure.

I am currently on L1 visa and want to apply for H1 through a small-time consulting company. However, I will decide on joining the new company only after I get the H1 visa.
* Is it get H1 visa and not join the company that has filed for my H1?
* Can I legally continue with my current company even after I get my H1?
* Can I join a third company instead of joining the company that has filed for my H1?
Can people share their experiences?

- One would expect that they open the package and send it back with a letter stating a reason for refusal
- What evidence can an applicant present in such a situation that his package was attempted to be delivered? (no fedex tracking number or other such reference).
